We recently acted for a young lady who was injured when she tripped over a stack of cardboard boxes which had been left at the end of an aisle in a supermarket. There were no warning signs or barriers present to prevent the accident and after attending hospital our client was diagnosed with a fractured wrist.

A shop or supermarket owes a duty of care to all its customers and visitors to ensure that their premises are safe. On this occasion we took the view that the supermarket was in breach of their legal duty and advised our client that we would take her case on a no win no fee basis.

We contacted the supermarket’s insurers with detailed allegations and obtained an early admission of liability.

We then arranged a medical examination for our client and were able to recover full compensation for her injury as well as recovering her financial losses.

What to do after your accident

Keep a record of the time, date and precise location of the accident. Seek medical attention at the earliest opportunity. The supermarket is legally obliged to make a record of the accident so you should ensure that the accident is reported to them. It is not always easy to obtain details of witnesses or staff present especially when you have been badly injured but do keep a note of any financial losses – such as painkillers – as well as receipts, as we will include them in your claim.

Often friends and relatives render care and assistance if you are unable to carry out certain activities, eg driving or domestic chores. It is helpful to keep a record of what assistance was given, when and for how long as this can also be claimed.

A Letter of Claim was sent to the UK Representative of the Defendant’s Insurers together with a copy of the Constat Amiable signed by the Defendant which was completed immediately after the accident. Enquiries were then undertaken by the UK representative and ultimately an admission of liability was received. The client was examined by our medical expert close to her home and ultimately the claim was settled, without the need to attend Court, in the sum of £3,750.00.

Mrs. A. consulted us on behalf of her mother who had been a resident in a residential care home for a couple of years.   The client, who suffered from Alzheimers, walked from one room to another.  As she leant against an office door, she fell through the door, which was discovered had a broken lock, and sustained injury, more particularly a fractured pelvis.  The client subsequently died a short time after her fall in a care home.

Care Home Negligence Claim – Personal Injury Solicitors in Warrington, Cheshire

Liability for the accident was initially denied.  The residential care home alleged that it was not possible to watch all the residents at any one time and that they were free to move around the home as and when they saw fit.  Whilst they denied the lock on the door was defective, they were unable to provide any documentation in relation to inspection and maintenance of the door and, in particular, the lock itself.

Ultimately we were successful in obtaining an admission of liability from the Defendants without going to Court.

The claim settled for £5,000.00 which took into account not only the injury but also the fact that the Claimant did not suffer an extended period of pain following her fall by reason of her death.   The Defendant also paid the Claimant’s costs in full.

Professional Negligence Case Studies 

Case Study One

A solicitor’s firm submitted their client’s unfair dismissal claim to the employment tribunal one day after the deadline for submission of the claim expired.  Time limits in the employment tribunal are extremely short and, because the solicitors had missed the deadline, the claim was withdrawn, depriving the Claimant of the opportunity to obtain compensation from her ex-employer.  She therefore sought our advice and we negotiated a settlement of £7,000.00 on her behalf without having to issue Court proceedings.  Her legal costs were also paid by the solicitors’ insurance company.

Comment: It is the solicitor’s duty to advise his or her client about time limits for bringing a claim.  Where the solicitor is instructed to pursue a claim – as in this case – it is then the responsibility of the solicitor to ensure that the claim is issued in time.

Case Study Two

A firm of solicitors was successfully sued for professional negligence and further compensation was awarded to their ex-client after the settlement they obtained for him had failed to take account of a claim for activities he could no longer carry out, such as gardening, car repairs and DIY.

Comment:  There could be many thousands of similar claims whereby the claimant has failed to receive the compensation they deserve.  It is very important to be aware that there is a strict time limit within which to claim.  Legal advice should therefore be sought as soon as possible.  Call us on 01925 937070 for advice if you wish to discuss a possible claim. 

Case Study Three

A firm of solicitors negotiated a settlement of a client’s claim, claiming compensation for pain and suffering as a result of the injury, as well as loss of earnings.   However, the settlement which was recommended by the solicitors did not include a claim for future loss of earnings which, as the claimant would not be able to work again as a result of his injuries, was very substantial.  As the compensation was accepted “in full and final settlement” of the claim it was not possible to seek further compensation from the Defendant. 

The Claimant therefore sought legal advice as to whether he could seek compensation for his solicitor’s error.   The claim was settled for an agreed sum by the solicitors’ insurers without Court proceedings being issued.

Case Study four

In one case a solicitor advised a client to sign a Settlement Agreement from his employer waiving all his rights to bring a claim against them for unfair selection for redundancy in return for a lump sum.  Unfortunately the solicitor was unaware that the client was also pursuing a personal injury accident claim  against his employer.  As a result of signing the Settlement Agreement the client had also signed away his rights to pursue the accident claim resulting in a loss of several thousands of pounds. 

Comment:  It was not possible to overturn the settlement agreement as the client had taken independent legal advice.   In this case the solicitor was negligent by not giving the correct legal advice as to what the settlement agreement covered and what was not included.

Petrol Pump Falling on Top of Client – Mr. B from Runcorn was employed as a field engineer for a petrol station.  A colleague was required to lift the pumps using a fork lift truck to allow Mr. B access under the pipes to carry out remedial pipework.  As the installation engineer was lifting the pumps, he lost his load resulting in the pump falling to the ground on top of Mr. B who was, at the time, checking the cable would not get caught and that the pump was able to move freely.

An ambulance was called and Mr. B was taken to the local hospital. Fortunately for Mr. B he escaped with minor injuries, bearing in mind the potential serious consequences of the negligence of the fork lift truck driver. Mr. B underwent surgery for the injury to his shoulder.
