We will discuss what is involved in making a Will and what the cost will be.
One of the most common questions we are asked is “how much does a Will cost?” However, no two Wills are the same. If you think about a car the price will vary massively depending on what you want. If you have modest assets and you are leaving everything to you spouse then you may want a basic Will. However, if you have substantial assets, wish to leave your estate to be divided between a number of beneficiaries, you are unmarried or have children under the age of 18 then a basic Will may not be suitable. You may also want to consider any tax implications, leaving money to charity and putting a portion of your estate into trust to protect against care home fees.
Everybody is different and will have different priorities, eg you may have an estranged family member that you do not wish to inherit from your estate. Simply leaving them out of your Will may not prevent them from making a claim on your estate after your death. If that happens expensive and stressful litigation can follow.
It is always best to take legal advice and have your Will professionally drafted so that it is appropriate for your circumstances. It is also much more difficult for someone to successfully contest your Will after your death, for example by alleging that the Will was incorrectly signed and witnessed. (Section 9 of the Will Act 1837). If the Will has not been properly executed then it will be ruled invalid and the Intestacy Rules will apply, in which case the law will decide who inherits.
