What if my solicitor has gone out of business or has no assets?
Solicitors are required to have in place professional indemnity insurance that will cover any such claims. We will investigate this at the outset of your claim.
Time Limits – Professional Negligence Claims
There are strict time limits for bringing a professional negligence claim against your solicitor, usually it is six years from the date of the negligence. However this may be extended where the negligence only becomes apparent at a later date known as “date of knowledge”. It is always best to speak to a solicitor as soon as you become aware of the negligence to ensure that you do not miss the time limit and your claim becomes ‘statute barred’, meaning that your claim is likely to fail as your solicitor will argue your claim is out of time.
What to do next
Time is of the essence in professional negligence claims, so please do not delay if you think you may have a claim. The Professional Negligence Pre-Action Protocol applies so that your solicitor’s insurers will be allowed almost 4 months to investigate the claim after receiving a Letter of Claim. It will also be necessary for us to obtain your file from your solicitor before investigations can commence and prior to sending a Letter of Claim. It can take some time for your solicitor to provide a copy of your file to us, so the sooner you act the better are your prospects of a successful claim.
