What is professional negligence?
Broadly speaking, professional negligence occurs where a professional (such as a solicitor) fails to perform their responsibilities to the required standard and that failure results in damage or loss to their client, for example missing a time limit for issuing Court proceedings or Employment Tribunal proceedings. A claim in professional negligence can be based on both negligent acts and omissions.
Professional negligence is a complex area of law and a number of requirements need to be satisfied in order for you (the claimant) to be able to bring a successful professional negligence claim.
Is there a time limit for bringing a professional negligence claim?
There is a six-year time limit for bringing a claim in professional negligence. When the six years have passed it still may be possible to bring a claim if the date when you first became aware of the circumstances that gave rise to a claim was a date within the last three years.
Paying for your professional negligence claim and “no win no fee”
If we think that you have a good professional negligence claim then we will find a way to fund it for you. We can act as “no win no fee” solicitors or investigate another funding method.
There is a variety of ways to fund your professional negligence claim:
- No Win No Fee – most of our clients choose to instruct us as “no win no fee” solicitors.
- Legal expenses insurance – you may be able to take advantage of another insurance policy that we can investigate for you.
- Private paying – for those clients who have no insurance and do not want to instruct us as “no win no fee” solicitors, we are always pleased to act on a private paying basis.
I think I have a case. What should I do now?
Due to strict time limits, it is important that you speak to a solicitor straight away to discuss whether you have a professional negligence case or not.
