Most of us have some property or assets that we want to be given to loved ones when we die. For some that might be just a few important possessions such as a car or a savings account. It can also include your home or other property.

If you die without leaving a Will it means you have died intestate in which case the state will decide how your assets are to be distributed. If you have a sizeable estate dealing with intestacy can take a long time and turn out to be very expensive.  For those left behind it will be a difficult period anyway so having a Will makes things a little easier.  A Will ensures that your nearest and dearest are aware of your wishes and enables them to handle your estate relatively easily.

Even if you have only a modest estate writing a Will is still a good idea.  The benefits of having a Will drafted include:

Appointing a family member as guardian of any of your children who are under 18.   

Ensuring that your partner is financially taken care of in the event of your death.  If you and your partner are not married (or are not in a civil partnership) your partner may not inherit any of your estate.  Even when you own the home jointly,  it is usual to hold the title to the property as tenants in common which means that the survivor will not inherit the deceased’s share of the property in the absence of a Will.   It is vital in this case that if you wish your partner to inherit the house after your death that you make a Will.    

Choosing your executors.   You can appoint people that you know and trust.

There may be personal items – perhaps only of sentimental value – that you want to bequeath to a family member or close friend.  Emotions can run high following a death and In the absence of a Will family disputes can arise as to what your wishes would have been.     

If a family member is excluded from your Will they may bring a claim under the Inheritance (Provision for Family and Dependents) Act 1975 which can result in the assets of the estate being severely depleted by legal costs.   

Allegations of undue influence or lack of capacity are common challenges to a Will and if proven will invalidate the Will.   Resulting Court cases to defend such claims can be extremely costly, lengthy and stressful.
