Unfortunately, being involved in a road accident as a cyclist can have very serious consequences. The law recognises this and in January 2022 changes were made to the Highway Code to improve road safety for vulnerable road users, including cyclists. Amongst the changes was a new rule about the hierarchy of road users which places those most at risk at the top of the hierarchy.
Rule 211 states that drivers of motor vehicles should not turn at a junction if to do so would cause a cyclist going straight ahead to stop or swerve.
Rule 212 states that drivers should take extra care and give more space when overtaking cyclists in bad weather (including high winds) and at night.
Rule 213 states that cyclists may suddenly need to avoid uneven road surfaces and obstacles, such as drain covers or oily/wet patches, so should be given plenty of room.
A significant number of accidents occur when motorists turn out of a side road without noticing the presence of a cyclist. Some accidents are caused by drivers failing to notice a cyclist on their nearside and turning left causing a collision.
Being involved in an accident as a vulnerable road user can result in very serious injury as well as financial loss such as medical expenses, out-of-pocket expenses, loss of earnings and replacement, clothing, helmet and gloves etc. Compensation is awarded based on the seriousness of your injuries and the impact on your life. Compensation can be awarded for ongoing and future rehabilitation costs, including physiotherapy.
