A statutory declaration is a formal statement confirming that the contents are true.   They are usually required if you are getting married abroad to confirm your identity and your marital status.  

Statutory declarations are also used in situations where a company director has to confirm that a company is solvent.     

Other examples may be where a bank or financial institution requires this to transfer funds to an executor after the account holder has died. 

A statutory declaration is a form which contains a statement of fact.   The person signing the statutory declaration is confirming that the contents of the statutory declaration are true by virtue of the Statutory Declarations Act 1835.

An affidavit, on the other hand, is a statement made under oath (or affirmed).   Affidavits are usually used in evidence in Court proceedings.

To be valid a statutory declaration or affidavit must be witnessed by a solicitor who is independent and impartial.  This means that the solicitor who witnesses your signature cannot be the same solicitor who drafted the affidavit or statutory declaration.  

How much does a statutory declaration cost?

Verifying oaths, affidavits and statutory declarations – £5.00 plus £2.00 per exhibit (attachments).

Certifying documents to be true copies of the originals – £10.00 per page. 

Witnessing a signature to a document – £10.00.

What is the process for witnessing a statutory declaration ?

We will need to see you in person, but the whole process should take no longer than 10 minutes.  You will be asked to confirm that the name and signature on the statutory declaration is yours and that the contents are true.  We recommend that you call us on 01925 937070 or email diane@dsmlegal.co.uk to make an appointment.
